Frequently Asked Questions

  • Questions

  • After Being Injured, What Steps Should I Take?

    Answer

In the days following an accident, we advise you to write down as many details about the accident as possible. Make note of all conversations had with the individuals involved. Preserve evidence and locate witnesses who may be able to help prove your case. Notify the party or parties responsible that you intend to file a claim against them. Lastly, and most importantly, secure the assistance of an injury attorney.

  • How Long Do I Have To File A Claim?

    Answer

The statute of limitations govern the amount of time you have to file a personal injury claim. Depending on the circumstances of your case, you may have one year. Exceeding this deadline may result in your claim being dismissed. Due to the time sensitive nature of your injury lawsuit, we suggest you contact our attorney as soon as possible. We will review the details of your case and inform you of your rights.

  • What If I Was Partially At Fault?

    Answer

If you were partially responsible for your pedestrian accident, you will likely bear some of the responsibility for the accident. This will result in reduced recovery.

  • What Damages Might I Be Entitled To Recover?

    Answer

You may be entitled to recover damages for medical expenses, lost wages, pain and suffering. Depending on the unique circumstances pertaining to your case, you may also be awarded punitive damages. In pedestrian accident cases resulting in wrongful death, the survivors of the victim may be entitled to recover full compensation for economic losses and damages.

In a collision between a pedestrian and a motor vehicle, the results are often catastrophic. As a pedestrian, you have no protection and are at the mercy of the driver.
